BELIVMART CUSTOMER TERMS & CONDITIONS

These Customer Terms & Conditions ("Terms") govern access to and use of the BelivMart platform.
By clicking "I Agree", registering, or using the BelivMart mobile application or website (the "Platform"), you agree to be legally bound by these Terms.
1. DEFINITIONS
- "BelivMart" / "Company" means Kuvi Technomart LLP, operating under the brand name BelivMart.
- "Platform" means the BelivMart mobile application, website, and related services.
- "Customer" / "You" means any individual using the Platform to place orders or avail services.
- "Merchant" means restaurants or businesses listed on the Platform.
- "Delivery Partner" means independent third‑party service providers who fulfil deliveries or rides.
2. ACCEPTANCE OF TERMS
By accessing or using the Platform, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not use the Platform. Continued use after updates constitutes acceptance of revised Terms.
3. ELIGIBILITY
You must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Provide accurate and complete information when using the Platform
4. USER ACCOUNT
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities carried out through your account.
- BelivMart may suspend or terminate accounts for misuse, fraud, or violation of these Terms.
5. SERVICES OFFERED
BelivMart is a technology platform that enables:
- Discovery of Merchants
- Ordering of food or products
- Bike taxi (two‑wheeler passenger transport) services
- Parcel delivery services
BelivMart does not prepare food, provide transportation, or act as a courier service.
6. ORDERING & TRANSACTIONS
- Placing an order constitutes an offer by you to purchase goods or services from a Merchant or Delivery Partner.
- Acceptance of an order is at the discretion of the Merchant or Delivery Partner.
- Estimated delivery or ride times are indicative and not guaranteed.
7. PRICING & PAYMENTS
- Prices, delivery charges, service fees, and taxes are displayed on the Platform.
- Final charges may vary due to distance, time, demand, or route changes.
- Payments must be made using approved payment methods available on the Platform.
8. CANCELLATIONS & REFUNDS
- Cancellations may attract charges depending on the stage of order or ride.
- Refunds, if any, shall be processed as per BelivMart’s refund policy.
- BelivMart reserves the right to deny refunds in cases of misuse or fraud.
9. CUSTOMER CONDUCT
You agree to:
- Treat Delivery Partners and Merchants respectfully
- Not engage in abusive, illegal, or unsafe behavior
- Not misuse the Platform, ratings, or promotions
10. RATINGS & REVIEWS
- Ratings and reviews represent individual opinions.
- BelivMart may remove or moderate reviews that violate policies.
11. DATA & PRIVACY
Use of the Platform involves collection and processing of personal data. Such processing is governed by BelivMart’s Privacy Policy, which forms part of these Terms.
12. INTELLECTUAL PROPERTY
All content, software, trademarks, and branding are owned by BelivMart or its licensors. You are granted a limited, non‑exclusive right to use the Platform.
13. DISCLAIMER OF WARRANTIES
The Platform is provided on an "AS IS" basis. BelivMart does not guarantee uninterrupted access, merchant quality, or delivery timelines.
14. LIMITATION OF LIABILITY
BelivMart shall not be liable for indirect or consequential damages. Maximum liability, if any, shall not exceed the amount paid by you for the relevant transaction.
15. BIKE TAXI & PARCEL SERVICES – ADDITIONAL TERMS
15.1 Nature of Services
BelivMart acts solely as a technology platform connecting Customers with independent Delivery Partners. BelivMart does not provide transportation or courier services.
15.2 Bike Taxi Services
- Bike taxi services involve transportation of a single passenger on a two‑wheeler.
- Customers must comply with safety requirements including helmet usage where required by law.
- Ride estimates may vary due to traffic, weather, or road conditions.
15.3 Parcel Services
- Parcel delivery is subject to size, weight, and content restrictions.
- Prohibited items include illegal goods, hazardous materials, explosives, narcotics, cash, jewellery, alcohol (where restricted), or items prohibited by law.
- Customers are solely responsible for parcel contents and packaging.
15.4 Cancellations & No‑Shows
Late cancellations or no‑shows may attract cancellation charges as displayed on the Platform.
15.5 Safety & Insurance Disclaimer
Road travel involves inherent risks. BelivMart does not guarantee accident‑free rides or deliveries. Any insurance coverage, if provided, is subject to separate terms.
15.6 Limitation of Liability (Bike Taxi & Parcel)
BelivMart shall not be liable for loss, damage, theft, or delay of parcels except as required by law. Liability, if any, shall be limited to the amount paid for the specific ride or delivery.
16. SUSPENSION & TERMINATION
BelivMart may suspend or terminate your access for violation of these Terms or applicable laws.
17. MODIFICATIONS TO TERMS
BelivMart may modify these Terms at any time. Continued use of the Platform indicates acceptance of revised Terms.
18. LANGUAGE & TRANSLATION
These Terms are drafted in English. Translations are for convenience only; the English version shall prevail.
19. GOVERNING LAW & JURISDICTION
These Terms shall be governed by the laws of India. Courts at Bengaluru, Karnataka shall have exclusive jurisdiction.
